TERMS & CONDITIONS

We understand that it isn't always possible to keep our intentions, but in fairness for all – students, teachers, venues and vendors – we adhere to a strict, no-exceptions purchase, booking and cancellation policy.

By booking/purchasing/showing up, you are affirming that you are physically and mentally fit to participate in the class/course/retreat/event. Our Yoga Alliance accredited courses have zero-tolerance attendance requirements – exceptions/alterations/modifications/make up hours may be considered on an individual case basis.

Terms of Agreement

1. By purchasing a product, or booking and attending an online or live class, workshop, retreat, course, yoga teacher training, etc with The Conscious Life Collective (Richard Husseiny and Anna Sugarman) and/or Anna Sugarman Yoga (Anna Sugarman), which govern The Conscious Life Collective/Anna Sugarman Yoga’s relationship with you, in relation to our product and/or offering:

(a) The term ‘The Conscious Life Collective’ or ‘Anna Sugarman Yoga’ or ‘us’ or ‘we’ refers to the owner(s) of the company. The term ‘you’ or 'I' refers to the student or guest or user or viewer of our website(s) and/or services/products. The terms ‘yoga teacher training’ or ’retreat' or 'workshop' or 'holiday' or ‘class’ or ‘course’ or ‘product’ refers to all aspects of the services on offer, to include, but not be limited to, the classes, accommodation and activities.

2. Booking/Purchase Procedure

(a) Upon making a purchase or a booking with us, each person accepts the terms of these conditions.

(b) Upon contacting us to express your interest, we will reply to accept your purchase/booking and for bookings will request a non-refundable deposit payment with payment instructions. Payment is by bank transfer or credit card or PayPal as stipulated by said purchase/booking and is due immediately upon purchase of a product or subscription. For events (class/workshop/retreat/training/course), your place is confirmed only when the deposit payment has been received. The final reminder will be sent to request payment for the remaining balance which will be due 60 days before the event start date. If the balance of your event is not paid within 60 days of the start date, we reserve the right to cancel your spot and retain your deposit.

(c) If making your booking within 8 weeks from the start date, the full balance will be due upon acceptance. An email request for the full amount will be issued and is to be paid immediately. In this case, your place will be confirmed once full payment has been received.

(d) Subject to clause 2(e), all payments are non-refundable. This includes deposit, installments, full payments, and balances.

(e) A refund will only be issued if the event is fully booked and someone else can fill your space. In this case, a refund does not include refund of your deposit and any monies owed will be paid to you within one month after the event end date.

(f) We reserve the right to increase the price of the event before you submit your booking. Any change in price will be advised to you before you book.

(g) We reserve the right to reduce the price of the event or run special offers at any time. Once you have made your booking and paid your deposit, installments, or full balance, any price changes will not apply to you.

(h) Optional trips and treatments booked locally are not our responsibility – they are at your own risk and cost.

3. Cancellation Policy

(a) As stated in section 2(d) all payments are non-refundable. For this reason we strongly recommend that you obtain travel insurance to potentially cover you in the event of cancellation.

(b) Once the event has commenced, no refund or partial refund or unused portion of your event will be repaid in the event of cancellation by you.

(c) In the unlikely event that the event is cancelled by either party, there will be no refund or compensation available from us for your flight costs, transfers and other associated costs.

(d) We reserve the right, in any circumstances, to cancel the event, in which case we will offer a refund in full of all monies paid (unless the reason for cancellation is force majeure, see clause 3(e)).

(e) Compensation will not be paid if we are forced to cancel or in any way change your event due to war, threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure.

(f) It is not possible, at any stage, to transfer your booking to another event or service.

(g) No refunds will be made for purchase of products.

4. Changes to Event

(a) It is unlikely that we will have to make any changes to your event – arrangements are made many months in advance and changes may rarely occur. We reserve the right to, within reason, change information advertised at any time, including but not be limited to dates, times, timetable, location, accommodation, teachers and prices. We will advise you of any changes at the earliest possible date.

5. Surcharges

(a) Unless stated otherwise, transportation costs including, but not be limited to, flights, transfers and taxis, are not included in the price of the event. Any prices of these are shown as an estimate only and we will not be liable for any differences to what was originally estimated.

6. Insurance and Health

(a) It is your responsibility to inform the teacher of any injury/medical conditions when booking and before the start of every session. It is advisable that you consult a doctor or physician before attending the event to ensure you are sufficiently fit and healthy to undertake yoga, breath, meditation, movement classes and any other activities involved.

(b) If you experience any injury or discomfort during any activity organised for you, you must stop immediately and advise the teacher(s) accordingly.

(c) We recommend all guests of live immersive retreats/trainings/courses/etc obtain full travel insurance to cover medical expenses and personal belongings, which should cover the type of physical exercise that will be undertaken. We hold no responsibility for illness, injury, death, or loss or damage to personal belongings at any time (as per the liability waiver in section 7), nor will any compensation be issued in such cases.

(d) We reserve the right to stop your participation in any activity, at any time, if we conclude that you are physically, mentally or emotionally unable to do so.

7. Liability Waiver

(a) It is an essential requirement of anyone attending an event and/or classes with The Conscious Life Collective/Anna Sugarman Yoga to accept and abide by the following release of liability:

'I understand that, while the utmost care is taken, neither the company (The Conscious Life Collective or Anna Sugarman Yoga), nor the individual teachers (Richard Husseiny, Anna Sugarman, and/or associates), nor the venue will be liable for any damage or injury resulting from my practice or use of the centre, nor any loss or damage to personal belongings. I understand that events/classes may be physically strenuous and I voluntarily participate in them with the knowledge that there is risk of personal injury, property loss or death. I recognise that it is my responsibility to notify the teacher(s) of any illness or injury before the start of every session and I will not perform any posture or activity to the extent of strain or pain. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against the company (The Conscious Life Collective or Anna Sugarman Yoga), its teachers (Richard Husseiny, Anna Sugarman, and/or associates) or its members for any injury, property loss, or wrongful death, whether caused by negligence or otherwise.'

(b) The release of liability statement applies to the duration of the event and every session or activity in which you participate, whether in a group or private setting, and/or off premise/outside of the event. If this statement is not accepted, your booking will be terminated and any monies paid in advance will not be refunded.

8. Alcohol/Drugs Policy

(a) Guests should not practise yoga or any activity under the influence of alcohol, drugs, or both, and doing so will result in immediate dismissal from the session, training/retreat/event, and/or both, with no refund issued.

9. Right to Refuse

(a) We reserve the right to dismiss or refuse entry to any session or event, at any time, at the teacher's discretion with no refund issued, in the event of breach of any of these terms and conditions, or disruptive behaviour.

11. Passport and Visa Requirements

(a) You are responsible for ensuring that you have a valid passport with sufficient time before the expiry date remaining and any necessary visas or required inoculations or other health requirements for events overseas.

12. Complaints

(a) In the case of a problem during your event, please inform a member of our team immediately – we will promptly strive to set things right. If your complaint cannot be resolved locally/internally during the event, please inform us in writing as soon as possible. Please note that we cannot guarantee the female/male ratio in any group (unless it is strictly one or the other), nor can we be responsible for the individual behavior of any group member, other guest at your event, or staff of a venue/outside of our team – we will however always endeavor to ensure your safety and comfort.
